2. KBC Sustainability Services BV processes your personal data for various purposes

 

2.1. PROCESSING OF PERSONAL DATA

KBC Sustainability Services BV will never collect more data than it needs for the purposes described in this data protection statement.

2.2. THE VARIOUS PURPOSES

The processing of personal data by KBC Sustainability Services BV is always based on one of the legal grounds stated in the General Data Protection Regulation (GDPR). Below, we will indicate for each of these legal grounds for which purposes Impact uses your personal data.

 

2.2.1. Contractual obligations and provision of services

KBC Sustainability Services BV aims to ensure that an energy consultant provides personal energy advice and sets their advice out in an energy advice report. If applicable, they may also prepare a quote. In order to be able to tailor this advice to your specific needs and situation, we need to process certain personal data. This involves only the data needed for the performance of the contract.

 

2.2.2. Consent

KBC Sustainability Services BV will request your consent to process your personal data in certain cases. You may withdraw this consent at any time. If and when you withdraw your consent, we will terminate all processing operations based on this consent. However, this will not affect the lawfulness of any processing carried out on the basis of valid consent given prior to the withdrawal.

 

For instance, you must give KBC Bank consent (through your relationship manager, for example) to transfer certain personal data (such as your name and contact details) to KBC Sustainability Services BV to allow us to contact you.

 

We will also request your consent to transfer certain data (such as the energy advice report) to your relationship manager.

2.2.3. Legitimate interest

KBC Sustainability Services BV may process personal data if this is necessary for the purposes of its legitimate interests. These are inspired by the need to function as a business and to enable new initiatives to be developed and offered to customers. In that regard, KBC Sustainability Services BV ensures that the impact on your privacy is kept to a minimum and that, in all events, KBC Sustainability Services BV’s legitimate interests remain proportionate to the impact on your privacy. Nonetheless, if you harbour an objection to your data being used in this way, you may exercise your right to object. KBC Sustainability Services BV will respect your objections unless there are compelling reasons for not doing so.

 

Any data you provide on the website may also be used by KBC Sustainability Services BV for quality surveys in the broadest sense and to gain a better understanding of the market. Moreover, we will use your personal data for statistical purposes and to improve our website and develop new functionalities and services.

For instance, KBC Sustainability Services BV transfers your data to Sustainable Impact BV in order for them to prepare a quote.

KBC Sustainability Services BV may also rely on certain processors. These are companies that process data on the instructions of KBC Sustainability Services BV (such as subcontractors, a consultancy firm, etc.).

KBC Sustainability Services BV will not provide personal data to any other third parties, unless it is obliged to do so based on a statutory provision or a decision given by a court or supervisory authority, or if this is necessary in order to prevent, detect or prosecute criminal offences (such as fraud, deceit or swindling), or if you have given consent.

 

4. Retention periods

Retention periods for personal data are an important aspect of data protection legislation (GDPR). The basic principle is that personal data may not be retained for longer than is necessary for the purpose of the processing. The duration of the period in which your personal data is retained depends on the type of personal data and other factors. In any event, it is never retained any longer than the time needed to achieve the purpose of the processing. When the data retention period has expired, KBC Sustainability Services BV will delete your data.

Personal data relating to contracting parties will be retained for up to ten (10) years after termination of the agreement.

Personal data relating to prospects will be retained for up to twelve (12) months from the date of collection.

5.1. RIGHT OF ACCESS

If you want to access the data concerning you that is processed by KBC Sustainability Services BV, let us know. You have the right to request access to all your personal data processed by us. We can only grant this request if you state what personal data you would like to receive. If you exercise your right of access, KBC Sustainability Services BV will give you as complete a list as possible of your data.

 

5.2. RIGHT TO RECTIFICATION

It can happen that certain information held on you by KBC Sustainability Services BV is not (or no longer) correct. You can ask for this data to be corrected or completed at any time.

 

5.3. RIGHT TO ERASURE

You can ask KBC Sustainability Services BV to erase your personal data. If KBC Sustainability Services BV no longer has an overriding ground for processing your personal data, we will erase it. However, a legal requirement may prevent the erasure.

If you disagree with how KBC Sustainability Services BV invokes its legitimate interests to process certain data, you can object to such use. Please be as specific as possible when you wish to exercise your rights, so that KBC Sustainability Services BV can handle your request appropriately.
